A "money transfer" is defined as the transmission of funds to a designated recipient, pursuant to payment terms entered directly by you into the website. A "recipient" is defined as the individual designated by you as the receiver of the money transfer, who is acceptable to us, and who receives the money transfer at a designated paying agent location. A "paying agent" is defined as an entity, appointed by us, to pay out money transfer transactions in the destination country identified in your payment instructions. "Service charge" is defined as the fee charged by us in connection with the money transfer. In these Terms of Use, "you," "your," and "user" refer to the person giving this consent.

(1) Consent to use Electronic Records, Notices and Communications

As part of your relationship with A TO Z 4U LTD, you are entitled to receive certain information, such as notices, disclosures and statements in writing or through email. To help with our efforts to protect the environment, and to facilitate website and mobile application use of our service, we ask that you give us permission to provide these notices, disclosures and statements to you electronically; otherwise we will be required to furnish them to you in paper form.

  1. Your consent to disclose information for identification purpose:

The law requires all financial institutions to take all possible measure to stop money laundering activities and funding of terrorism by obtaining, verifying and recording identification about all our customers. We may therefore require you to provide us personal identifying information such as National ID card, Passport or Driving License by uploading picture of such documents relating to you or Recipient and we may also legally consult third parties sources to obtain information about you and the recipient. We will verify your residential address and personal details in order to confirm your identity, we may also pass your personal information to credit reference agency, which may keep a record of that information. Be assured that this is only to confirm your identity and we do not perform credit checks and therefore your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the data protection Act 1998 and the EU Data protection regulations apply from 25th May 2018. By accepting these terms and conditions you authorize us to validate the information that you provide to us. We may do this directly, for example by asking you for additional information, or requiring you to take steps to confirm ownership of your Payment Instruments or email address; or indirectly, for example by verifying your information against third party databases or through other sources.

You consent to our processing your personal information for the purposes of providing the Service, including for verification purposes as set out in this clause.

You also consent to the use of such data to enable us and our authorized third parties to verify your details, and for statutory, accounting and archival purposes, in accordance with the terms of A TO Z 4U LTD Privacy Policy. By "current version," we mean a version of the software that is currently being supported by its publisher.

We reserve the right to discontinue support of a current version of software if, in our opinion, it suffers from a security or other flaw that makes it unsuitable for use with your account. And we always reserve the right, in our sole discretion, to communicate with you via the UK Postal Service.

A TO Z 4U LTD will not open an account of any person who does not appear him/herself in the office or appears on behalf of somebody else or his/her proof of identity is not verified.

  1. Proof of Identity (ID)

Proper Identification Documents will be required to be uploaded (PDF, JPG, PNG format) from original. These basic identification documents include photo IDs such as valid passport or UK’s driving licence or National ID card. Other IDs include proof of address documents like bank’s letter, Bank

Statement, HMRC letter or council letters.

For In-branch customers you will be required to submit in original and the customer should be present at one of the branches or agent location of

A TO Z 4U LTD in person at the time of opening a money transferring account with A TO Z 4U LTD. These basic identification documents include photo IDs such as valid passport or UK’s driving licence or National ID card. Other IDs include proof of address documents like bank’s letter, HMRC letter or council letters.

  1. Unique Identification Number (UIN)

On acceptance of the Identification Documents an account will opened for the customer containing his Unique Identification Number (UIN). The person whose account is opened will be issued account number (UIN). This number will be required for use in all money services transactions made by that person through A TO Z 4U LTD.

  1. Money Transfer Services: Salient Features

A TO Z 4U LTD aims to provide to its customers a quick, reliable and costless money transfer service with a good exchange rate. The company transfers money the same day or very next day except on the bank holidays. However, the money transfer might be delayed if there are discrepancies in the documents; like the details of the receiver on his/her proof of ID submitted at the receiving end do not match with that which the sender has provided at time of transferring the money OR it could also be delayed in extreme situations and for unforeseen reasons such as strikes or telecommunication failure.

  1. Locations of Collection Points:

A TO Z 4U LTD deals with major banks in Pakistan, India, Sri Lanka and Bangladesh; money remitted can be collected from any of branches of those banks. These Banks have branches throughout a country and also in remote areas. The option for selecting the collection point will be available when sending money from your login.

  1. Changing / Correction of the Collection points:

If a customer for some reason desires to change the designated collection point; then you have to cancel the payment order (see CANCELLATION section below) and submit new order with corrected details and collection point. * Exchange rate may vary & will be applied as of the day, order is submitted*.

  1. Collection Pin Number:

At the time of the undertaking the transaction a PIN NO comprising of 6 digits will be issued to the sender. It will be responsibility of the customer to convey that Collection Pin No to the beneficiary of the money. The beneficiary will not be able to receive the payment until he/she knows the correct

Collection Pin No. The Customers are strongly advised not to disclose the Collection Pin number, value of transfer or other information about the remittance to any person other than the intended recipient.

  1. Online Transfer Facility for Senders:

A TO Z 4U LTD also offers Bank to Bank and ‘Online transfer facility’ to its account holders. They can transfer online and transfer via chap or through

Faster payment service straight into A TO Z 4U LTD's bank account in real time (immediately), without any delay. For security purposes the staffs of A TO Z 4U LTD has been advised to establish the identity of customer before making the transaction by asking from the account holders their identification details; such as name of the account holder, date of birth, address, UIN number, telephone number and other information. This information is essentially required to establish customer’s identity and also to protect the customers from any misuse of their account by criminals.

  1. Cancellation:

If customer wants to cancel a payment, then you can do it over the phone/email but after establishing his identity. This cancellation is only possible before the money transferred has either been credited to the recipient’s account or collected by him. In case of timely cancellation, it will normally take 10 working days to reverse the transaction and customer has to come in the office in person with the original receipt to collect the money if in-branch service is used when sending money, if transaction was sent through online web portal than funds will be transferred back to customers account or

Debit/Credit card from which money was transferred. The exchange rate fluctuations might affect the money received back. *Cancellation charges will also be applied*.

If you instruct us to pay a money transfer to a designated recipient and later request that we stop the payment of such transaction, we will need to check first with the paying agent to determine if the money transfer has been paid to the recipient. If we can confirm that payment has not been made, the money transfer will be cancelled and we will refund the amount of the money transfer, excluding the service charge and transfer fee. The exchange rate fluctuations might affect the money received back. Your refund will be in GBP.

All refunds shall be available within Ten (10) calendar days of the stop order or as soon as the refunds are returned by the paying agent and, whichever

I/We hereby declare and confirm that the money being remitted through A TO Z 4U LTD by me/us is not derived or obtained by any illegal means and transactions are linked to any unlawful activities. I/we also herby confirm that the details and documents provided to A TO Z 4U LTD are true and have not been tempered in any way. I also undertake to inform A TO Z 4U LTD of any change in my circumstances and also if asked by A TO Z 4U LTD to provide them with any information they might seek with respect to transactions made with them.

Acceptance of the Terms of Use

You agree to immediately notify A TO Z 4U LTD of any unauthorized use of your user name or password, PIN or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You agree that you are only allowed to create and maintain one registered user account. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any user identification code or password, whether chosen by you or provided by us, in our sole discretion for any or no reason, including, if in our opinion, you have failed to comply with any provision of these Terms of Use.

The Service

A TO Z 4U LTD provides registered users of the service (each a "user") with the ability to initiate money transfers to designated recipients located in many countries around the world, over the Internet using a Visa® or MasterCard® credit card ("credit cards"), or a Visa® or MasterCard® branded debit card issued by bank ("debit cards"), or user's bank account with a financial institution ("bank account"). In order to use the service, you will be required to provide us or our partners for financial transaction verification with information necessary for us to verify your identity, to obtain proper bank card or bank account authorization, and to complete the money transfer in compliance with applicable local and foreign laws and regulations. Recipient information and verification may also be required. When required by applicable law, money transfers will be reported to local or foreign authorities. Unless explicitly stated otherwise, any new features that augment or enhance the current service, shall be subject to these terms of use.

 

Currency Exchange

If you instruct us to pay out a money transfer to a recipient in a currency ("payout currency") other than UK Sterling pound ("GBP"), a retail exchange rate may be applied, in addition to any service charge appearing on the face of your receipt. The payout currency for such money transfer is acquired by us at a wholesale rate that fluctuates, but may approximate the wholesale rate for such payout currency listed website such as the www.xe.com. The difference between the retail exchange rate applied to such money transfer transaction and the wholesale exchange rate at which we acquired the payout currency will be kept by us and/other paying agent as revenue, in addition to any service charges.

The paying agent must pay out money transfers in the payout currency indicated in the money transfer payment instructions. If a recipient desires payment of the money transfer in a currency other than the payout currency, the recipient and paying agent must enter into a separate foreign exchange transaction to convert the payout currency into the recipient’s currency of choice ("foreign exchange transaction"). Such foreign exchange transaction is a separate transaction between the recipient and the paying agent only and A TO Z 4U LTD has no responsibility for or liability in connection with such foreign exchange transaction.

Payment Authorization

When you initiate and submit a money transfer transaction on the website, you authorize A TO Z 4U LTD (or its designated agent) to charge your designated Debit/credit card account or debit your designated debit card or bank account for the amount of such money transfer transaction and A TO Z 4U LTD's associated service charge. You are responsible for ensuring that your designated payment method has sufficient funds or credit available for payment of your money transfer transaction. If A TO Z 4U LTD executes payment of a money transfer pursuant to your money transfer instructions and subsequently is advised that your designated Debit/credit card had insufficient credit available or your designated debit card or bank account had insufficient funds available, you remain liable to

A TO Z 4U LTD for the full amount of any such payment of the money transfer by A TO Z 4U LTD and the A TO Z 4U LTD's associated service charge. You authorize us to initiate debit and credit entries to your bank account in connection with the money transfer service. You also authorize us to initiate credits and debits to correct errors. This authorization shall remain in full force and effect until we have received notification from you of its termination; you may revoke your authorization only by notifying us by telephone at +44 20 843 47400 or in a written email sent to info@atoz4ultd.co.uk or in written letter sent to Bombay Bazar Unit 7,8,9,10,140, Ealing Road, Wembley, HA0 4PY. Attn: Customer Service that is received at least three (3) days prior to the proposed effective date of the termination of authorization. You agree that all transactions authorized by you shall comply with all applicable local and foreign law.

Money transfers that have been authorized by a user shall be processed only on the condition that the issuer of the respective credit card or debit card, or the user's bank, has authorized the corresponding charges or debits. Each user using the service acknowledges and agrees that the Company is authorized to charge the respective credit card or debit card, or debit the respective bank account, for the principal amount of the money transfer, the service charge, and any other applicable fees. The issuing bank for your credit card or debit card or the financial institution where your bank account is open may also have terms and conditions that apply to your use of the credit card, debit card or bank account (as applicable) and you must refer to such agreement(s) in order to determine user's rights, obligations and liabilities as a cardholder or account holder, which may include the assessment of cash advance or other fees. Money transfer receipts will not display fees assessed by user's bank or the issuer of user's credit card or debit card.

Services Charges and Additional Fees

In consideration of your use of the service, you agree to pay a service charge per money transfer executed through the website or mobile application. The service charge will be charged to the credit card, debit card, or bank account you identify as the payment method for your money transfer transaction. The service charge (in addition to any other applicable fees charged by us directly or on behalf of any local or governmental authority) will be displayed online for your authorization prior to submission of the money transfer. Our service charge schedule is subject to change from time to time in our sole and absolute discretion.

In addition to any fees charged by A TO Z 4U LTD, a money transfer may be subject to additional fees assessed by the UK government, where the money transfer originates, the government of the destination country, or the financial institution in the destination country at which your recipient holds a bank account.

Money Transfer Processing and Delivery Schedule

After we have verified your identity, received proper credit card, debit card, bank authorization and completed the screening for proper compliance with the various applicable laws and regulations, the money transfer is made available to the designated recipient for pick up at a paying agent location, or deposit into recipient’s bank account in the destination country. The speed of payment of a money transfer varies depending on a variety of factors, including but not limited to, the amount of the transaction, the restrictions of the destination country or point-of-payment (including without limitation the paying agent's hours of operation), and/or the accuracy of the information provided by the user. Money transfers will normally be paid to the recipient by cash depending on the instructions by you, availability of currency or other conditions existing at the point-of-payment.

Money Transfer Cancellations and Refunds

If you instruct us to pay a money transfer to a designated recipient and later request that we stop the payment of such transaction, we will need to check first with the paying agent to determine if the money transfer has been paid to the recipient. If we can confirm that payment has not been made, the money transfer will be cancelled and we will refund the amount of the money transfer, excluding the service charge and transfer fee. The exchange rate fluctuations might affect the money received back. Your refund will be in GBP or the currency you have paid to process the order. All refunds shall be available within ten (10) calendar days of the stop order or as soon as the refunds are returned by the paying agent and, whichever is first. Expired Transfers

If you ask us to process a Transfer to an individual Receiver to be collected in cash at a payout Location and the Transfer Amount has not been collected within ninety (90) days, we will treat the Transfer as no longer capable of execution (an "Expired Transfer"). We will have no obligation, after that ninety (90) day period, to execute an Expired Transfer. If you become aware that a Transfer Amount has not been collected please contact us to ask for a refund.

 

Money Transfer Transactional Restrictions

We reserve the right, in our sole discretion, to: (i) reject a proposed money transfer; (ii) limit the amount of a money transfer; (iii) require additional information to complete a money transfer; and/or (iv) take reasonable measures with respect to a money transfer in an effort to comply with applicable laws and regulations.

As a user, you agree not to attempt to circumvent the parameters of the service by using a different debit or credit card or bank account, entering false information, or any other means. The service is offered exclusively for the personal money transfer needs of users. Any other use or attempted use of the service for commercial purposes, promotion of products and services, or other such purposes, directly or indirectly, by you or by a third party is prohibited.

The service available through the website is limited to money transfers for a maximum amount of GBP1999.99 per user per calendar day following account enrollment. The maximum aggregate amount of money transfers per user during any rolling thirty (30) calendar day period is GBP 2,999.99. A TO Z 4U LTD may establish any and all transactional restrictions applicable to money transfers in its sole discretion and may change such restrictions from time to time. We will provide you with any legally required notice, which we may post on our website.

When you submit a money transfer, the paying agent is not required to accept it. You agree that you will not hold us liable for any damages resulting from a paying agent's decision not to accept a money transfer made though our service. Any unclaimed, refunded or denied payment will be returned to you or to the original payment method. We will return any unclaimed money transfer to you, or to the original payment method, within thirty (30) days of the date we are informed that the paying agent has rejected your money transfer transaction.

If you provide us with incorrect recipient information, we will contact you to correct the recipient information or process a refund of your money transfer.

If you use your mobile phone to make money transfers, you are responsible for any fees that your phone service provider charges, such as fees for SMS, data services, and any other fees that your phone service provider may charge. Your phone service provider is not the provider of these money transfer services; instead, the Company is the provider of these money transfer services.

SMS Messages

Users may elect to enroll in the SMS ALERT program in order to receive notifications and alerts about their money transfer transactions. Users may opt-in to receive such SMS notifications by agreeing at the time of opening account with us, in response to an opt-in message. Message and data rates may apply. To stop receiving SMS ALERT messages, Users may also call at +44 20 843 47400 or email info@atoz4ultd.co.uk for assistance. Once enrolled in the SMS ALERT program, a user will receive number of messages per money transfer transaction submitted by the user on the website. The mobile carriers participating in the SMS ALERT program are only UK’s registered mobile networks. If a user's mobile carrier is not a UK registered mobile network, the user may not enroll for SMS ALERT notifications. If you enroll in the SMS ALERT program, you are responsible for any fees that your phone service provider charges, such as fees for SMS, data services, and any other fees that your phone service provider may charge.

Intellectual Property Rights

The website and mobile application and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof, are owned by A TO Z 4U LTD, its licensors or other providers of such A TO Z 4U LTD and are protected by UK and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Indemnification

Dispute Resolution by Binding Arbitration

Any dispute, claim or controversy of any kind arising out of or relating to this agreement or the breach thereof shall be settled exclusively by arbitration Administered by FINANCIAL OMBUDSMEN SERVICE which covers all businesses authorized by Financial Conduct Authority in accordance with its Commercial/Financial Arbitration Rules. The FOS Rules are available online at www.financialombudsmen.org.uk. The FOS is not a regulator or an industry trade body. Nor are the FOS a consumer champion or a government body. Their job is to settle disputes without taking sides.

The FOS are totally impartial and consider each dispute on its own merits – making what the FOS believe is a fair and balanced decision, based on the facts and circumstances of the individual case.

The official ombudsmen are like judges. But sworn witnesses, cross-examinations and formal legal procedures are not part of their usual process for resolving complaints.

The FOS can get to the bottom of most complaints just by writing to – or phoning – the people involved. And the FOS tells consumers they do not usually need professional, legal or financial help to bring a complaint to them.

i- Being ‘covered by the Financial Ombudsman Service’ - what does it mean?

In simple terms, it means that our company must have in place – and operate – in-house complaints-handling procedures that comply with the complaints handling rules. And any complaint that the company is unable to settle to the consumer’s satisfaction – or within the required timescales – can then be considered by the Financial Ombudsman Service.

If the company is unable to resolve a consumer’s complaint, we must tell the consumer of their right to take their complaint to the Financial Ombudsman

Service. All ‘eligible complainants’ can bring a complaint to the ombudsman service.

ii- Financial Ombudsman Service and our customers

In accordance with the FOS rules, our company has published a summary of our in-house complaints-handling process. This means we have:

  • set out how we seek to handle and resolve any relevant complaints and
  • Explained that – if the complaint is not resolved – the consumer may be entitled to refer it to the Financial Ombudsman Service.

All customers are informed of this information as part of the transactional process - also via websites and receipts as to the availability of this summary.

Telling our customers about the Financial Ombudsman Service helps to underpin our customer’s confidence in our business and the payment services we provide.

iii- Who is an ‘eligible complainant’?

This is the term used in the FOS rules to describe those who can complain to the ombudsman.

Complaints can be made by, or on behalf of, customers (or potential customers) who are:

  • Private individuals
  • Certain businesses with a yearly turnover of under £1 million (some restrictions apply)
  • Charities with a yearly income of under £1 million
  • Trusts with net assets of under £1 million.

In some circumstances, the FOS can accept complaints from consumers who are neither customers nor potential customers of the business being complained about.

Examples include employees covered by a group insurance policy held in the name of their employer, or someone who has given the business a guarantee or security for a loan.

iv- Complaints-handling rules

These rules, requiring businesses covered by the Financial Ombudsman Service to have in-house complaints-handling procedures, reflect what is widely considered to be good practice. The rules apply to businesses that are or have been authorized by the FCA or the OFT. In the context of payment services, the complaint- handling rules also apply to companies which are eligible to be regulated by the FCA under the Payment Services Regulations but which are, for the moment, taking advantage of the transitional provisions applicable to them.

v- When a customer complains – what action to take?

The Financial Ombudsman Service won’t consider a complaint until our company have first had the opportunity to deal with it ourselves. So it is our company policy that we will always investigate any complaint and decide how we want to respond to it.

The complaints-handling rules require us to try to resolve complaints at the earliest opportunity. The rules set out time limits of 15 business days after the day on which it received the complaint under regulation 101 of PSD2 for eligible complaints for dealing with complaints. This means that we must send the consumer a ‘final response’ (or explain why we are unable to do this) within 15 business days of after the day we received the complaint.

We must also send the complainant details of how to contact the ombudsman service and a copy of the FOS leaflet titled ’your complaint and the ombudsman’.

These are ordered via the FOS website or by phoning the FOS publications helpline on 0300 123 9 123, 0800 023 4 567.

vi- What is a ‘final response’?

A final response will include the following points as required under the rules:

  • give a summary of the complaint, setting out the result of your investigation and your final view on the issues raised by the customer;
  • say whether you acknowledge there has been any fault on the part of your business;
  • give details of any offer you are making to settle the complaint;
  • enclose the FOS leaflet and;
  • Tell the consumer about their right to refer the dispute to the Financial Ombudsman Service within six months, if they are unhappy with your response. If, at the end of eight weeks, we want more time to investigate the complaint – and the customer agrees to this – the ombudsman service will not automatically get involved.

But we must still tell the customer about their right to take their complaint to the Financial Ombudsman Service. If the consumer takes their complaint to the ombudsman service after eight weeks – and they are satisfied, from what we tell them at this stage, that the complaint has special features which mean we clearly do need more time – then the FOS may decide not to look into the complaint immediately.

We do not ask FOS for any time extension as a matter of routine.

vii- What are the time limits for consumers bringing unresolved complaints to the ombudsman service?

The complaints-handling rules set time limits for consumers to complain to the ombudsman – after which our company can choose to object to the ombudsman looking at the complaint, on the grounds that it is ‘time-barred’.

Generally these time limits are:

  • Six months from your business sending the consumer a final response;
  • Six years from the event the consumer is complaining about (or, if later, three years from when the consumer could reasonably have known they had cause to complain).

While some businesses are happy for the ombudsman to consider all complaints made against them, even if the consumer has missed the formal time limits. We reserve the right to object to the ombudsman considering a complaint we have received – where we believe that any of these time limits has already expired – then we will let the FOS know as soon as practically possible.

Depending on how clear-cut the issue is, the FOS will:

  • Dismiss the complaint straight away, telling the consumer that they are too late to complain; or
  • Investigate further, to check dates and the full circumstances – including asking the consumer why they didn’t complain earlier.

However, in ‘exceptional circumstances’ the FOS does have the discretion to look at complaints that fall outside these time limits. An example might be if the consumer was incapacitated during the period when they could have complained.

viii- We must comply with an ombudsman’s decision

If the consumer accepts the ombudsman’s decision, it is binding on us. The rules require us to comply promptly with any money award or direction that the ombudsman makes.

If we do not do this, the consumer can go to court to enforce the award or direction, if necessary. And the relevant regulator may take into account any failure to comply with an ombudsman’s decision.

We must also comply promptly with any settlement we may have agreed to make at an earlier stage of the FOS process – for example, during conciliation orfollowing an adjudicator’s view.

Waiver and Severability

No waiver of these terms of use by A TO Z 4U LTD shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of A TO Z 4U LTD to assert a right or provision under these terms of use shall not constitute a waiver of such right or provision.

If any provision of these terms of use is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the terms of use will continue in full force and effect.

Entire Agreement

The terms of use, our privacy policy, and your receipt for any money transfer transactions constitute the sole and entire agreement between you and A TO Z 4U LTD with respect to the website and your effecting money transfer transactions through the website, and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the website.

Changes to the Terms of Use

We may revise and update these terms of use from time to time in our sole discretion by posting a revised version on our website. Except as otherwise required by law, the revised version will be effective at the time we post it.
